Terms of Service and End-User Agreement

Version 2026-09-13-v1

Operator display updated September 14, 2026 to use the registered trade name. The proprietor, service, prices, and substantive policy provisions are unchanged. Original published versions remain available for order records.

Published September 13, 2026. These terms apply when affirmatively accepted for an order or a validly agreed update. Publication alone does not replace an existing customer's agreement, establish historical acceptance, or authorize a new charge. Contact support for a previous version applicable to your order.

1. Agreement and operator

Facilities Bid Radar and FBRAlerts.com are operated by Storm Studio Solutions, a Florida sole proprietorship (we, us, our). You must be at least 18 and authorized to agree for the business using the service. The selected plan, accepted order terms, and Cancellation and Refund Policy form the service agreement. The Privacy Notice explains data handling; receiving it is not blanket consent to unrelated processing or promotions.

2. The subscription service

You are purchasing an ongoing, remotely operated information and email-delivery service. Facilities Bid Radar filters, ranks, summarizes, and links to selected public federal procurement notices for facilities contractors using the services and geographic preferences in your profile. Subscription fees pay for organization, filtering, presentation, and delivery, not privileged government access. Public notices are available directly from official sources without a subscription.

This is not a sale of the underlying software, source code, government database, or ownership of procurement information. Emails and any reports expressly included in your plan are outputs of the subscribed service. A downloadable report does not, by itself, turn the subscription into a one-time asset purchase or waive cancellation, refund, or statutory rights. Separately priced reports or other digital products require their own order description, price, delivery terms, use rights, and applicable refund terms; they are not included merely because they appear in a demonstration.

Only features described as available in your purchased plan are included. Internal pilots, roadmap items, and illustrative examples are not commitments to deliver additional paid features. Coverage depends on supported sources, filters, available data, and operating conditions. We do not promise every relevant notice or a minimum number of opportunities.

3. Payment, activation, and delivery

The standard plans are US $29 per month or US $290 per year, plus applicable taxes, unless a different offer is expressly shown and accepted at checkout. The annual amount is billed in full, not in monthly installments. Any currency-conversion offer and its total are shown by the payment provider before payment. The selected recurring price and interval at checkout govern your order.

The initial charge and billing period begin when checkout payment succeeds, not when you finish onboarding or receive your first digest. Personalized delivery requires successful subscription verification and completion of the secure onboarding link sent to the checkout email address, including your service preferences and eligibility attestation. Delaying onboarding does not pause billing. If the link is missing or activation fails, contact support@fbralerts.com promptly for activation help and applicable billing remedies.

After activation, digests are scheduled for the next applicable daily run, normally at 6 AM Eastern Time. Source outages, quota limits, maintenance, payment issues, filtering, or email-provider restrictions can affect availability or timing. No matching result is not by itself a service defect. We do not promise guaranteed inbox placement, continuous monitoring, a specific uptime percentage, or a fixed support-response time. These limitations do not excuse a material failure to provide the service sold.

Keep your delivery address and preferences current and check spam or filtering rules. Contact support when delivery appears missing or incorrect. An email send log may help investigate a problem; it is not proof that you read, received in your inbox, or benefited from an alert.

4. Renewal and cancellation

Your subscription renews automatically at the selected interval and disclosed recurring price until canceled. By completing the express agreement and payment process, you authorize recurring charges on that basis. We will disclose material price or renewal changes and provide notices or obtain additional consent when applicable law requires. A policy update or an informational email does not authorize an undisclosed new charge.

Cancel future renewal through the Stripe customer portal linked on FBRAlerts.com, using the checkout email address. You may also email support@fbralerts.com with a clear cancellation request if you need help or cannot use the portal. We do not require another purchase or a retention conversation to process a valid request. Cancellation normally stops the next renewal and leaves service available through the current paid period, subject to applicable rights and refunds. Retain the cancellation confirmation and contact support if it does not arrive.

Unsubscribing from opportunity emails stops those emails; it does not cancel subscription billing. Use the billing portal or explicitly request billing cancellation to stop renewal. Canceling billing and controlling optional promotional messages are separate choices. Necessary service, security, or legally required notices may still be sent as appropriate.

5. Independence and certification

We are not SAM.gov, GSA, SBA, a contracting office, or a government agency, and are not affiliated with, sponsored by, endorsed by, or acting for them. We do not represent that any government agency or independent certification body has certified or approved our alerts, fit scores, summaries, software, or workflows. Agency names and source links identify information, not endorsements.

We do not certify your business, validate a set-aside designation, or decide eligibility for an award. Select only categories your business currently qualifies for and update them when circumstances change. Official rules and solicitation requirements, not a fit score or subscription, determine eligibility.

6. AI, automation, and official-source review

Some expressly released features may use artificial intelligence or automated processing. Outputs can be incomplete, outdated, fabricated, incorrectly extracted, or inconsistent, even when fluent or accompanied by a citation. A citation identifies material to review, not proof that the interpretation is correct. Human review is not included unless your purchased feature expressly includes it.

Official notices, attachments, amendments, agency instructions, and applicable rules control. Before pursuing, pricing, or submitting a bid, independently check status, scope, deadlines and time zones, location, eligibility, site visits, labor requirements, insurance, security requirements, submission instructions, and amendments with the official source. Maintain your own deadline controls. A missing alert does not mean no obligation or opportunity exists.

An alert is a source snapshot, not continuous surveillance. An AI response is not a legal determination, account-action confirmation, refund authorization, certification, or bid submission. We do not provide legal, tax, accounting, engineering, insurance, security, or procurement representation. We do not guarantee accuracy, awards, revenue, profit, eligibility, or a measured amount of time saved.

7. Account and submitted content

Provide accurate business and contact information, protect secure access links, and use only accounts you are authorized to use. You may permit authorized personnel within your business to use the service for internal purposes within the purchased plan. Notify support of suspected unauthorized access.

Submit only information you are authorized to provide. Do not put passwords, full payment-card details, Social Security numbers, classified material, controlled unclassified information, export-controlled technical data, government access credentials, or confidential bid documents in general notes or support forms. Restricted-document processing would require a separate agreement and security review.

You retain rights in your submitted content and grant only the permission needed to store, process, and use it to provide, support, and secure the requested service and meet applicable obligations, consistently with our Privacy Notice. This is not an unrestricted license for unrelated use of your confidential content.

8. Use rights and third-party materials

During your paid service period, you have a limited, non-exclusive, non-transferable right to access the purchased service for your business's internal purposes. You may retain lawfully delivered emails and included reports for internal reference after cancellation. Cancellation ends ongoing monitoring and delivery at the applicable service end date, not your ability to keep previously delivered copies. Retained outputs remain snapshots and are not kept current after delivery.

Our original branding, design, software, and authored materials belong to us or the relevant rights holder. Public facts, government materials, third-party marks, and source documents remain subject to their applicable rights and terms. We do not claim exclusive ownership of public government facts or that all AI output is unique or protectable. Service rights do not include resale or redistribution of our protected feed or materials, except as permitted by law or separate permission.

Do not impersonate a government body, misstate qualifications, distribute malicious content, access another account, compromise systems, or use the service unlawfully. Copying, scraping, and reverse-engineering restrictions apply only to the extent permitted by law and rights we actually hold; they do not remove statutory exceptions or rights in public materials. Good-faith security reports may be sent to support without accessing others' information.

9. Refunds and billing errors

Our Cancellation and Refund Policy describes first-charge service-failure review, renewal treatment, billing errors, and service-discontinuation remedies. Report suspected errors promptly without sending full card details. An automated response is not confirmation that a refund or cancellation occurred. Nothing in these terms limits a nonwaivable cancellation, refund, payment-dispute, or statutory right.

10. Changes, availability, and suspension

Sources, models, filters, interfaces, and workflows may change. We may perform maintenance, correct errors, or respond to security and legal issues. We will communicate material changes in paid functionality when required and provide appropriate cancellation or refund remedies for material nonperformance under the agreement and applicable law. An update does not authorize an undisclosed charge or eliminate mandatory remedies.

We may proportionately restrict access for abuse, unauthorized use, payment failure, material security risk, or legal requirements, explaining the reason and review path when lawful and reasonably practical. Urgent risks may require immediate action. Suspension does not erase accrued rights or valid refund obligations.

11. Warranty disclaimer

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE SERVICE IS PROVIDED AS IS AND AS AVAILABLE. WE DISCLAIM IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT, AND WARRANTIES THAT OUTPUT IS ACCURATE, COMPLETE, CURRENT, ERROR-FREE, OR UNINTERRUPTED. NO INFORMAL MESSAGE CREATES A WARRANTY UNLESS AN AUTHORIZED WRITTEN AGREEMENT EXPRESSLY PROVIDES ONE.

This does not disclaim an express commitment we actually make, permit deceptive conduct, or exclude a warranty or remedy that cannot lawfully be excluded. Applicable law may give you additional rights.

12. Liability limitations

To the extent permitted by law, neither party is liable to the other under these terms for indirect, incidental, special, consequential, exemplary, or punitive damages, or lost profits, business opportunities, or anticipated savings arising from use of the service, even if advised of the possibility.

Subject to the exceptions below, our total aggregate liability arising from the service or these terms will not exceed the greater of US $100 and the service fees paid or payable by you for the twelve months immediately before the event giving rise to the claim.

These limitations do not apply to fraud, willful misconduct, gross negligence, death or personal injury to the extent liability cannot lawfully be limited, or any liability, statutory right, refund, or remedy that applicable law does not permit the parties to limit. They do not excuse misleading advertising, unlawful billing, or failure to perform legally required security or privacy duties. Being uncertified is not immunity from responsibility.

13. Support, disputes, and changes to terms

Contact support@fbralerts.com with a description of your concern and proportionate information to identify the account. Contacting support is not a condition preventing you from exercising nonwaivable rights or contacting a regulator. These terms do not impose mandatory arbitration, a class-action waiver, or an exclusive forum.

We maintain dated versions and will identify material changes, give required notice, and obtain fresh affirmative agreement when required. We will not backdate changes, extinguish accrued claims retroactively, or treat silence as agreement to an undisclosed charge or materially different data use. Customers declining changes retain applicable cancellation and refund rights.

If a provision is unenforceable, the remaining provisions continue to the extent lawful. A failure to enforce once is not a permanent waiver. These terms and the applicable accepted plan or order form the service agreement, subject to nonwaivable law.
